H1B Transfer at the end of 6th year

Recommended Posts

I am on a H1B visa, with an approved labor (EB2) and I-140 with Company A. My current visa is valid till July 15, 2013 and at the end of this date I will be completing my 6 years of H1B. At this time, company B is offering me a full time position.

Now here are my questions:

Question 1:

If I join company B, will I get my H1B transfer approved and get a 3 year extension on H1B? I was told that since I don't have an approved labor and I-140 with company B, the immigration services would not approve my H1B transfer and give me a 3 year extension. Is this correct?

Question 2:

Suppose I let company A file for H1B extension and get a 3 year H1B extension, can I later transfer my H1B from company A to company B without any issue? Would the immigration services retain the 3 year H1B extension they offered through company A to company B as well? I shall ask company B to apply for a new labor and I-140 within the 3 year H1B span.

I request you to clarify this questions for me.

Thanks
