prasanna2211
I am on a H1B visa, with an approved labor (EB2) and I-140 with Company A. My current visa is valid till July 15, 2013 and at the end of this date I will be completing my 6 years of H1B. At this time, company B is offering me a full time position. Now here are my questions: Question 1: If I join company B, will I get my H1B transfer approved and get a 3 year extension on H1B? I was told that since I don't have an approved labor and I-140 with company B, the immigration services would not approve my H1B transfer and give me a 3 year extension. Is this correct? Question 2: Suppose I let company A file for H1B extension and get a 3 year H1B extension, can I later transfer my H1B from company A to company B without any issue? Would the immigration services retain the 3 year H1B extension they offered through company A to company B as well? I shall ask company B to apply for a new labor and I-140 within the 3 year H1B span. I request you to clarify this questions for me. Thanks NPV Link to comment
pontevecchio
1. It is not correct. You were misinformed. 2. Usually and ordinarily, Yes. Would you not feel better getting a Lawyer to opine? Link to comment
