dummy Posted May 3, 2013 Report Share Posted May 3, 2013 Am on H1 visa and crossed my 6 year limit. Currently on periodic H1 extensions based on pending I-485. I-140 is approved. Have EAD and Advanced Parole, never used EAD or AP for travel or work. Priority date is 2006. I-485 was filed in EB3 during August 2007 rush and I wasn’t married then, so spouse’s I-485 is not filed yet since PD was never current after the marriage. So she is on H4. Considering we both should stay in US below are the questions. Number of job openings (what I am trying for) is lesser for H1 folks than for people who don't need employer sponsor. 1. Should I maintain my H1 status always so spouse can stay in the US? 2. If I switch jobs, are there chances for filing GC again in a better EB category such as EB1 or EB2? Or does it trigger RFE or denial? 3. If I switch jobs, can I join only if the new employer is sponsoring H1 (for H1 transfer)? 4. If I plan to switch jobs and the new employer does not sponsor H1, then if I use EAD. What would happen to spouse’s status? Link to comment
