xfitter Posted May 3, 2013 Report Share Posted May 3, 2013 Hello experts, requesting your advice. I am currently working for company A on H1B - this is the 7th year. I140 is approved in EB3. If I transfer to company B, based on my approved I140 from company A, I understand I am eligible to get a 3 year extension if company B's job qualifies. Assume I started with company B after transfer and company B has not started GC process yet. If I now want to trasfer H1B to company C, how long can I expect to get my H1B when company C files for the transfer? Assuming the job with company C too qualifies, would I get another 3 years with company C based on approved I140 from company A, or would I get it for remaining period from my 3 years of Company B's H1B, or is it something else? pontevecchio Posted May 4, 2013 Report Share Posted May 4, 2013 No H1 extension can be for more than 3 years at a time. Other than that you need to discuss specifics with a Lawyer. If A revokes your I-140 tomorrow your 3 year extension beyond the initial 6 years stands. Link to comment
