Regarding cap-exempt petition filing

Hi,

My I 94 got expired on 5th February 2013. for 5th Feb it complete 6years from the approval of my H1B. But i relocated to Inida in June 2011. Since then i am working in Inidan company. out of 6 years i have used only 4 years of my H1. I have nearly 2 years on unused H1B. Since my H1B is expired now, is it possible for me to request my employer for cap exept h1 B filing . I appriciate your advice on this.
