giga Posted April 29, 2013 Report Share Posted April 29, 2013 Hi, I am on H1b entering into 6th year. My company haven't applied for my permanent residence so far. I do have EAD through my spouse who is also on H1b. My lawyer informed me that they will not be able to file 1 year extension to my H1b after 6 years of H1b expires. My question is, If I switch from H1b to EAD now: 1. WILL I save my H1b period which can be used later on in case of any issues with EAD renewal? 2. IF there are some issues with pending AOS application or my spouse looses her job, what will be the implications on my job? 3. IF I loose my job, will I still in status? 4. IF I have to switch back from EAD to H1b, what is the procedure? thanks in advance. Link to comment
pontevecchio Posted April 29, 2013 Report Share Posted April 29, 2013 1. Yes. 2. Your EAD stands UNTIL the pending AOS is rejected and that gives you a lot of leeway and time. 3. YES 4. a SPONSOR FILES AND GETS A h1 PETITION APPROVED. 5. Please keep a Lawyer on retainer till you get the GC. Link to comment
