H4b stamping with approved H1 starting Oct 1st

Hi,

I am currently on H4 (Visa expried) and i would like to travel once my H1B is approved (starting Oct 2013). I need to go to Visa stamping on H4 in india since my visa is expired and would like to come back sometime in august. Can i start working on H1B once i come back to US and will my status be automatically change to H1 on october 1st (according to last action rule?)

or do i need to go apply for change of status from H4 to H1 again since i got my H4 stamped and so my status will be H4 (and not H1) since i get a new 1-94 card on re-entry to US.

Any help would be greatly appreciated.

Your H1 status can only start up to 10 days before October,1. I suggest discussing the matter with the company.
