My question is - If i get my visa transferred right now, will i get the new visa validity till Sep 15th 2013 or will i get the validity for 3 years ? I also have my I-140 approved. Actually i am in the 6th year of my H1B with my current employer. And my I-140 is for my current employer. Even then i will get the 3 yrs extension if i get transferred to new employer? SameerH1Bworker Posted April 19, 2013 Report Share Posted April 19, 2013 Yes, you MAY get 3 years extension even with new employer ONLY IF new employer can show 3 years of work contract + submits your I-140 to uscis with H1B transfer forms Link to comment

0407 Posted April 19, 2013 Report Share Posted April 19, 2013 based on approved I-140 you will get unlimited H1b extensions (typically 3 years at a time). Petitioning employer need not be the petitioner of I-140. Your I-140 should not have been withdrawn when extension is sought. Also, Priority Date of I-140 should not be current Link to comment
