Query21 Posted April 17, 2013 Report Posted April 17, 2013 Hi All, I have been working with a consultancy for 1.5 yrs now. My H1B was approved through them last year. Now the client whom I am working with has offered me a full-time position and has also sponsered my H1B transfer. However, we received a RFE recently. - I have worked in India for 3 years. - Have Masters from US When my consultancy had filed for H1 last year , they had requested me to get a letter from my employer in India and had mentioned that if we the employee mentions that I worked 20hrs/week that should be enough. I did get that since I worked almost 30-35 hrs and mentioning 20hrs/week wasn't a problem. However, for H1B transfer RFE I need documentation that says I worked 30+ hours in India. Now my concern is the company is willing to give the letter since the information is correct, however since USCIS already has a document that says 20hrs/week from my previous petition it might affect adversley. Please help and suggest what are my options. Thank You!
pontevecchio Posted April 18, 2013 Report Posted April 18, 2013 If the information was correct no self respecting or ethical employer would give you a letter saying you worked for 20 hours when you were working full time. Your option is to get a Lawyer onboard and listen to her.
