post2ramki Posted April 15, 2013 Report Share Posted April 15, 2013 Hi, My wife is on H4 and an Employer has applied H1B under H1B cap 2014. Now, her application will be processed under normal processing. Her case will be dealt as H4 to H1 conversion if her H1 get selected in the lottery. Now, I have got a good opportunity and i need to transfer my H1B. So, my question are: if i transfer my H1b. Should i transfer my wife's H4 also to my new employer? If i transfer my wife's H4 also to the new employer, what happens to her H1B application? Does it impact her H1B? What exactly i need to do? Need suggestions from you guys. wiweq Posted April 15, 2013 Report Share Posted April 15, 2013 As long as you are on valid H1b, your all H4s are valid. No need to update anywhere. If any RFE comes, it's your burden to show that your H1b was valid when H4 to H1b COS was filed. I hope that you had submitted your last 3-4 paystubs, employer letter while filing your wife's H1b to show your valid H1b status. Link to comment

nishkaanangel Posted April 16, 2013 Report Share Posted April 16, 2013 I was In the same boat last year... You can change the job,My husband changed the job after 15 days of my h1 filing. Just dont file your wifes h4 since there is already one application gpoing through COS. Link to comment
