Please clarify whether my H1B renewal can be sponsored under the cap-exempt category in 2013 for 3 years term (or remainder of approx. 42 months). My case is summarized as follows:

VISA stamp Issued date:19-Jun-2004 Expiration date: 31-Jul-2006

Renewal H1B Petition:

Valid from 1-Aug-2006 to 31-Jul-2009

VISA stamp Issued date:3-Aug-2006 Expiration date: 31-Jul-2009

Entry: 19-Dec-2004 Exit: 24-Feb-2005 (on original H1B) - Duration: 2 months 5 days

Entry: 13-Mar-2005 Exit: 28-Jul-2006 (on original H1B) - Duration: 16 months 15 days
