ayakkadan Posted April 10, 2013 Report Posted April 10, 2013 Hi all, My wife is currently on an H1B which is valid until February 2014. She will be changing jobs in the next few months. Her new employer has already initiated her H1B filing. Is there a period of time that she can legally stay in the US between jobs (for example, stop her current job on June 30, and start her new job on August 1, but stay in the US in between)?
wiweq Posted April 10, 2013 Report Posted April 10, 2013 Out of job/ payments on H1b means out of status. If you don't wanna work, file COS to other status.
pontevecchio Posted April 10, 2013 Report Posted April 10, 2013 She certainly can. She would have up to 60 days to report to the new employer. This assumes he is Ok with the scenario. In all such matters get hold of a Lawyer and discuss her specifics with him.
