Bittu Posted April 3, 2013 Report Share Posted April 3, 2013 Hi, My employer filed H1 last year 2012 and got some issue and he appealed for it but, still the case is psending with AAO. This year the same employer filed new petition for 2013 and he says that USCIS will give an option to withdraw either one if they find two petitions on one employee. My question is does USCIS revokes both the petitions they hold or they give an option with withdraw one of them.? Link to comment

shekar11# Posted April 4, 2013 Report Share Posted April 4, 2013 Hey Bittu, You shud be fine because both of your H1's were not filed the same year. I was in exact same situation in 2008 and my employer withdrew the new petition from USCIS after the old one was approved. Link to comment
