My H1b has been applied today but I am thinking of leaving job and go on H4 again before october 1st(for about a year or two). If I get approval for H1b, what happens to that approval? If I want to go back on H1b in the future will it be counted as H1 transfer or it will be new H1b process? Link to comment

If you are asking whether you will be cap counted if the current petition is approved the answer is YES. It can get complicated. Why are you letting the sponsor file a futile H1 petition? anand4u13 Posted April 10, 2013 Author Report Share Posted April 10, 2013 It is not completely futile. I am just not sure if I will be continuing my work till/after October or not. I might just end up going back on H4 to take care of my child if I can't keep up with work and child stuff. Link to comment
pontevecchio Posted April 10, 2013 Report Share Posted April 10, 2013 Once you have a H1 petition approved you are able to change employers as often as you like if they are willing to file a H1 petition for you which will not be cap subject. H1B should be use it or lose it to make sure only people ready and will to work get visas.If this person "wastes" an H1B, all of you who miss out on the quota need to be mad at her! Link to comment
