H4 Extension & New H4 for infant from INDIA

Hi,

I am going back on my valid H1 to USA this month. My VISA expires around September 2013. My Wife has H4 visa and i have a new born in my family who does not have H4 visa. My wife has never traveled to USA.

Question # 1: During my H1B extension this year, can my wife apply for H4 extension from being in my home country?

Question # 2: Can my baby can apply for a new H4? If so, does my wife needs to extend her visa during the same stamping process?

I have heard that my H1B extension proof is sufficient. Can anyone help me out on both of the individual cases?

since no details on when your wife will travel, I assume its after Sept 2013. Since your wife is in India. Get your extension done, When you have your new I-797. Schedule an appointment at the Consulate in India for wife/child and they should get the H4 visa. They would need your new I-797 for their interview along with other documents.

Both your baby and wife need valid visas

1. Nothing called H4 extension if she is in India. Any time she has a valid H4 visa and you have an approved extension petition she can come over. 2. You can apply for a H4 visa for the baby.
