sriram4sap Posted March 22, 2013 Report Share Posted March 22, 2013 Hi , I have filed for H1B in 2008 and by lucky it is filtered in lottery and after that due to some reasons i not attended the consulate for H1B(presently i don't have visa , just having valid H1B papers,am not in US) and it is expired on 06-30-2012. Here what is my concern is, can the employer re-apply H1B wth the same file, if yes can he apply with out related to April-Quota(CAP exempt -apply anytime). if NO,i have to go with same employer or can i go any employer to apply APRIL-Quota. can you help me on this issue and suggest me the best way to go for this. pontevecchio Posted March 23, 2013 Report Share Posted March 23, 2013 Any employer can file your H1 petition and on approval you can get the visa and come over. You are not cap subject. You need to make sure that you use the correction function of whichever word processing program you use to avoid grammatical errors. Link to comment
