I then did a change of status to H4 and I have a H4 I797 as well as my I94. As my husband hasn't visited India for last 4 years he does not have a H1B visa stamped on his passport but he has a valid renewed H1B I797 till September 2013. I plan to visit india alone now and I have following questions regarding my H4 stamping. Came accross many articles on internet but would like to confirm the information I got: 1. We have a marriage license issued by the State of California, but do I need to have a marriage certificate issued by Indian Embassy or any other Indian governing organization? 2. We have all the required documents of my husband's H1B except that his H1B visa on passport is old and expired as he hasn't visited India since his visa expired. Is this okay? 3. We do not have any marriage invitation card. Is that mandatory? Link to comment

Say he is working for the company associated with "Windows" there will be no problem. If this could be a problem talk to a Lawyer first. 3. No. Link to comment

Also, we will be able to provide all the supporting and valid documents of his employment. Although I will talk to a lawyer for this in further detail. Link to comment
