Here’s my situation: H1 issued by Employer A – 10/01/2009 to 09/24/2012 With Employer A, pay stubs were only issued from Jan 2011 – March 2011 since I needed three pay stubs to transfer to Employer B. H1 issued by Employer B – 06/01/2011 to 05/15/2014. With Employer B, pay stubs have been issued since 06/01/2011 to current. 2 questions: 1) Does only the period when pay stubs are issued count towards the number of years on H1? In other words, does the period from 10/01/2009 to 12/31/2010 count towards my H1 years since pay roll was not run. 2) How many years do I have left on H1? Thank you. Link to comment
JoeF Posted March 6, 2013 Report Share Posted March 6, 2013 Oh boy. Why was "payroll not run"? You need to get paid ALL THE TIME if you are in H1 status. You are in a lot of trouble. You need to discuss your situation with a good immigration lawyer. Link to comment
