Can I travel on valid L1 if H1 is in process

Hello,

I have valid L1B visa ending Dec 2013. I am going to India for some time and probably my employer will file H1 for me when I am in India.

Since my H1 is filed and is in process but I still have valid L1B.

Can I travel back USA on L1B? Also There might be case that I might my spouse with me on L2. Is it possible to file for her L2 and travel? Apparently her H4 will be filed too?

Help will be appreciated..!!

Your H1 if approved kicks in from October, 2013. If the H1 petition is filed before you are out of the country for 1 year the period in L1 status will be subtracted from your 6 year limit. You do know that if you stay in L1 status she can work on the basis of L2 EAD for any employer in any filed should she choose?
