tss_inc
Hi there, I am working for a company and utilized almost 5 years of H1b duration. I have my I140 approval from this company. Now I am planning to make a switch. So now when I make the switch to a new company, will I get a fresh new 3 years or will I get the remaining 1 year of the total 6 years of H1 stay. Please advise. Thank you. Link to comment
pontevecchio
You could get one plus two years assuming everything else is above board and the I-140 is not revoked. Link to comment
Attorney_10
Generally, an individual is eligible for the time remaining from his or her initial 6 years of H1B time. In addition, an individual with an approved I-140 petition may also be eligible for H1B extensions in three year increments based on AC21. Please schedule a consultation with an experienced immigration attorney to discuss the specific facts of your case and to determine how much time you are eligible for on your H1B extension.
