january2013
Hello all, I am going to get married soon and my fiance is in India. She works for a IT company and her H1B was approved last year. Their company is planning to get her visa stamped early next month and she have to work at client place in US after that. My question is, assuming her visa get stamped, there should not be any problem at all. In case of denial, what would be my options, 1) will that affect her H4 visa. 2) Once after she is here on H4 if she find's a job, can the interested employer apply for H1B at any time of the year or shlould they wait till new H1B quota is available. (she is already been counted against quota in 2012, not sure visa rejection at consulate mean complete cancellation of H1B petition) Thanks in advance. Link to comment
pontevecchio
1. No. Only your H1 credibility can affect her H4 visa. 2. Any time on approval of THAT H1 petition. Link to comment
