kandula1985 Posted January 15, 2013 Report Posted January 15, 2013 Hi My Employer X... is not paying from 2 months and whe i ask them he is saying that he didn't get the money from Vendor and when i contact the vendor they said they already paid to your Employer .what should i do now to whom should i complaint. Now he is not even providing the W-2 Form and he is saying all stories Please help me
chtummala Posted January 16, 2013 Report Posted January 16, 2013 he does not have to give w-2 now .. he got time till this month end .. and call him and say that you talked to vendor .. is your employment terminated with your employer ? if not he got to pay per state WH schedule .. if your employment terminated he can wait ..
JoeF Posted January 16, 2013 Report Posted January 16, 2013 File a complaint with DOL on form WH4. The DOL will make the employer pay you.I The employer absolutely has to pay you, no matter what. If they didn't get money from the client is their problem, not yours. And if you don't get a W2, you can report that to IRS. IRS will then also contact the employer.
JoeF Posted January 17, 2013 Report Posted January 17, 2013 I am on OPT Right now On OPT, you can't file a WH4. The WH4 is for filing a complaint about H1 violations. However, labor law says that you have to get paid for work performed. So, you may be able to file a complaint with your state Department of Labor. Check their website.
t75 Posted January 17, 2013 Report Posted January 17, 2013 You need to discuss your problems with your DSO. They need to be aware of your problems and may be able to obtain legal advice from the university's legal staff to assist you.
