I am planning to transfer my H1B to Employeer B. In the month of June I will be getting married, So my question is very simple. If I transfer My H1B to EmployeerB now & in the month of June Apply H4 for my spouse, should I also get My Visa Stamped under Employeer B ? or I can Apply H4 Visa for my spouse with latest i-797 form? pontevecchio Posted January 13, 2013 Report Share Posted January 13, 2013 You do not need to get a new stamp though you could if you wanted. She needs proof of H1 status for you to get a H4 visa besides proof of Marriage. The H12 visa is not proof of H1 status. Your H1 approval and the I94 are proof besides stubs, job letter etc. Link to comment
