IndiraCherekh Posted January 12, 2013 Report Share Posted January 12, 2013 Hello Friends, Need your expert opinion. I am in H4 Vissa status now and my husband in H1 status. We have applied GC as a future employer from Company-1 in which we never worked and concurrently filed I140 and I485 with priority date March-2004. I140 was approved and both of us got EAD's. But never used upto now. My husband is working in Company -2 from 6 years on H1 and last year 2012 they applied GC, and I140 was approved and priority date was ported from previous I140. Last month in December 2012 applied I 485. My husband wants to continue in company -2. Now I want to work on EAD (Company-1), but unfortunately Company -1 wants to revoke our I140. My questions are : 1. Can I work on EAD if Company-1 revokes I140? ( EAD expires on 2014 ,3 months back renewed) 2. What will be my status then? 3. Can I be able to renew my EAD after it expires? pontevecchio Posted January 12, 2013 Report Share Posted January 12, 2013 EAD is not company dependent. Company A can revoke the I-140 with no effect on you. You will be awaiting AOS as a derivative of your spouses Immigration petition. You can renew the EAD when it expires. In any case EB2 is current for you guys and you should be getting the GC very soon. Link to comment
