We are from india. My spouse will be going on student visa(F1) this fall 2013 and i am currently employed in an IT company. I can get work from home option as well.

My question is, can i apply for the dependent F2 visa and work while in the US for the indian company(Without change of payroll, still getting salary in my indian A/C)?

I have done quite a few read ups. But im not sure many are in this situation, so couldnt find answers.

Any help would be much appreciated.

While on F2 in the US, you can not work, not even remotely.

It doesn't matter where the company is located, it matters where you are located.

The answer is no -- a spouse (or child) is not allowed to be employed in any capacity whatsoever (regardless of the location of the employer, payroll, etc.) on a F-2 dependent visa. Further, any employment while in the U.S., even from foreign sources, has to be reported on U.S. tax returns.

You may NOT work on F2. It does not matter how you are paid but where your body is when you are doing the work. Either get a legitimate work visa (H-1B or L1) or stay home where you can work legally.

If your company has a US presence and you have worked there at least 1 year, ask if they will assign you on L1 to their US office. The US office can assign you to work remotely.
