mascot
Currently I am working with company A and I got an offer with company B, now company B want me to resign from company A and join them in 2-3 days. Now if company B files my petitions in next 2-3 days, then what I should do? Should I wait first for receipt then only resign company A or as company B is saying it is not illegal you can join us immediately, you will get your receipt with in 2-3 days. So When I should resign from my previous employer, because new company is ready to take me by next day of my resigning, but I just what to know what is legal to do. So whether I can join company B by monday, if my H1b filling is done by friday but I didn't received any receipt is it legal to work? And also, I wanted to know that my new employee is applying my H1 transfer in normal process if in case it get rejected, how much wait time I will get to search for other new filling for new employer or I need to return to my home country immediately?? pontevecchio
It would be an act of folly to start work for b on receipt unless B is say the intelligent company which makes semiconductors etc. Have them file with PP and once approved finish your notice and THEN join B. Link to comment
metroguy
yes it is perfectly legal to start working for company B based on just the transfer receipt. I did it twice. So if you think is a good company then you can join it Link to comment
