Am in EAD or H1B?

Hi there,

Please help clarify this question as couple of people have different opinions and no absolute clarity.

I've a valid H1B until 2015, renewed in 2012.

I also got EAD/AP card in 2012 and i used AP as travel document when i went to India and came back in Nov'12.

Would i automatically move onto EAD?

Or am i still on H1B and will move to EAD only if someone files ac21 petition?

No one filed a petition for ac 21 yet, so i assume im still on H1B. pls clarify!

Why in hades would anybody but you file a AC21 notification? Why do you NEED to be in H1 status?

In general, if a foreign national enters the U.S. using AP, s/he is in a period of authorized stay, not H1B status.
