lucknari Posted January 8, 2013 Report Share Posted January 8, 2013 Hi, I am currently on L1B and my employer is planning to convert my visa to H1 for Apr-2013 quota, my wife is on L2 now and applied for EAD (waiting for EAD) but i also need to convert her visa to H4, if she gets EAD approved till what time she can work ( as long as EAD valid or till she converts to H4 ) ? Some of my friends told i can hold L1 and H1 as long as no change in employer, in that case she can work on EAD until it expires? Please help me, i am trying hard to get this information, your hlep greately appreciated. Link to comment
pontevecchio Posted January 8, 2013 Report Share Posted January 8, 2013 She can work with a valid L2 EAD as long as you are in L1 status which means she is in L2 status. The moment you get H1 status she would need to be in H4 status. Hence INFORM your company that along with your H1 petition with COS from L1 they need to apply for her COS from L2 to H4 based on your pending petition. Link to comment
lucknari Posted January 12, 2013 Author Report Share Posted January 12, 2013 Hi, Thanks for the information, i heard of consular process for H1? will that be a good idea ? or is there any risk involved with that? if i go with my H1 in Consular Process so that no COS needed and i can continue with my L1 until it expires and she can be on L2.
