Visa Category Mismatch

My wife appeared for H4 visa interview and she was awarded H1 visa.

Neither of us noticed it till US officer at the immigration check point pointed it out. He said by mistake it was put H1 in the system and he cannot change it, he allowed her to enter US and put H-1 in the I-94 instead of H-4.

Did anybody faced similar issue of visa mismatch. Any way to rectify this?

Unfortunately this is one of those situations where you are not at fault and still need a Lawyer to guide you. Let us know what happens.

Something similar occurred with my wife's H-4 extension (years 4-6) petition. I noticed the mistake when I received the filing receipt and number in the mail. I promptly followed up with my company's attorney, and he advised me that receiving the wrong visa could cause problems even though it was solely the USCIS's mistake. He took care of 'fixing' the mistake before the actual processing and approval of her visa extension petition.
