lalitshivnani@gmail.com
I am a Green Card Hoder and would be applying for my US citizenship in Feb 2013. My wife is on H1B currently which is valid until Sep 2014. She came on L1 Visa in 2009 and her L1 got converted to H1B in 2011. I have following questions. - Should i apply for her green card right now or wait until i become US citizen - Would she be able to work on her H1B if i apply for her GC right now - Does L1 period count into her H1B years. Thanks in advance Link to comment
t75
Now Yes as long as she has valid I-94 L1 counts towards 6 years Link to comment
pontevecchio
Since you would be a Citizen by end 2013, you should consider filing at that point of time Even were you to apply now she can work on H1 status which is considered dual intent. L1 PLUS H1 equals 6 years in total. L1 periods are counted. Link to comment
