ravi88 Posted December 19, 2012 Report Posted December 19, 2012 my details: old I 797A expired date: 10/06/2012 USCIS received date for extension: 09/18/2012 USCIS approved date: 12/12/2012 But in I 797 they are given new petition is valid from 12/12/2012. what about the gap between 10/06/2012 to 12/12/2012. Do i need to resubmit my petition again? thanks in advance..
krialta Posted December 19, 2012 Report Posted December 19, 2012 This is common!! The validity will be from the approval date not something from your previous petition end date. Just a thought as I never heard of requesting this - Keep the copy of extension receipt dated 09/18/2012 handy to present it if asked.
pontevecchio Posted December 19, 2012 Report Posted December 19, 2012 Anecdotal evidence and Lawyer forums suggest they do not backdate and the fact that you got an I94 is proof of legal status in the interim . It is allegedly due to software deficiencies .

shellys1 Posted March 24, 2013 Report Posted March 24, 2013 Yes I do. I transfered from company A to B and got a receipt date of Oct 17 2012 and I started working from the same day. However I see that on my i797 the validity date is from Apr 1 2013. Does this mean that I should not have started from the receipt date?
