AnuGhu Posted December 17, 2012 Report Posted December 17, 2012 Hi everyone, Had 3 questions 1. I had an Stamped H1B ie. Issue date - Oct 2006 and expired in Sep 2009. I never used it , not a single day. I am in US on B1/B2 now and want to switch to another employer on H1B. Am I exempted from the H1B quota? Or do I need to apply in the FY 2013 Quota? 2. If I have to apply in the FY 2013 Quota? when can i start working? Can I start working after the H1B approval or have to wait till October 2013 to work? 3. Also if I apply in the FY 2013 Quota and I am in US on either B1 or B2 or L1 visa, can I switch from those to H1B in the US itself and start working immediately after approval? Your inputs will be greatly appreciated as it is very unclear to me if I am exempted from Quota and what is the approach I have to take. Thanks
pontevecchio Posted December 17, 2012 Report Posted December 17, 2012 1. You can find a H1 sponsor who will file a non cap H1 petition for you and get it approved. Then you need to leave and come back with a H1 visa. 2. You do not have to. 3. Why try so hard to avoid the H1 visa stamping?
