Basically USCIS is denying the petition for lack of proof of specialty occupation. Specialty occupation means that the job requires at least a Bachelor’s degree or its equivalent. It is a common way for USCIS to deny a case. In this case they are saying there is no evidence candidate qualifies for a specialty occupation and may not have the required skills and degree required for such work. As such, they are denying the petition for lack of concrete evidence. Education evaluation is also submitted. Is there any chance of MTR. Link to comment

t75 Posted December 18, 2012 Report Share Posted December 18, 2012 It sounds like either you or employer - or both - is not qualified for H1B. Their attorney should review the case. If they did not have an attorney, there is the problem. If you are a holder of at least a 4 year degree from an accredited university, find a new employer to apply for you. Link to comment
