anmadh Posted December 17, 2012 Report Posted December 17, 2012 I came to U.S. on H4 visa in Jan 2007, I applied for H1 visa in Oct 2008 , due to personal reason I was not able to go for a job at that time. I did not apply for change of status as my H4 petition( which was applied in Jan 2007 and also H4 stamping in the passport) was valid till July 2010. And in July 2010 my husband's H1 visa got extended, so along with that my H4 was also extended. So I just wanted to know whether this will cause any issue during stamping at embassy as I did not go for a job in H1. Please help. Thanks.
pontevecchio Posted December 17, 2012 Report Posted December 17, 2012 If your spouses job is with a credible company it is unlikely that you will have any trouble. In any case only one way to find out. Apply for the visa. They would not have extended your H4 status if you were not legal. Maybe the H1 approval was for CP.
anmadh Posted December 19, 2012 Author Report Posted December 19, 2012 So, my H4 visa (applied in Jan 2007) was not void when I applied for H1B in Oct 2008 ? Please reply. Thanks
pontevecchio Posted December 19, 2012 Report Posted December 19, 2012 Getting a H4 visa should not be a problem for you.
