Urgent COS related - Unique situation

Hi,

My friend has an unique situation:

He was on L1B through employer A, now employer B did his H1 with COS effective from 1st OCT 2012.He joins company B.But at the same time employer C got H1 approval for him with COS [L1 to H1]effective date 1st Dec 2012.As he did not join company C, canceled H1.

Now he is in dilemma if he went out of status, as last action by USCIS was to void his status.

What he should do now??
