H1 Rejected, can go to USA on H4 and reactivate my H1

Hi all ,

My H1-B visa got rejected in India recently after query.

My spouse is on H1 in USA.

Can i fly to USA on H4 and reactivate my H1B ??

You can come over in H4 status. You can find a H1 sponsor to file a H1 petition with COS from H4 for you and if approved you can start work from then on.

It is not possible to reactivate your H1B, you need to apply again for the CoS from H4 to H1B to USCIS but I guess you won't come under new quota, if you have a new job or you can ask your old employer to re-apply for H1 again.
