Hello,

I got my initial H1B in OCT 2006 thru SEPT 2009. I worked in US till MAR 2009 when I had to go back to India for a family need.

I stayed in India, got married in DEC 2010 (my spouse is a H1B holder), got H4 visa in MAR 2011 and came to US in DEC 2011. I now want to start working on H1B again, i have a few question regarding that.

1. Will my new H1B be subjected to cap.

2. Do i have to wait till OCT 2013 to start work.

I appreciate any feedback on my queries and thanks in advance for your time.

1. Not for 3.5 years. 2. See 1. 3. You can also get a new total of 6 years by having a sponsor apply in April for a start date in October.
