sparkle1 Posted December 12, 2012 Report Posted December 12, 2012 My husband already has a GC effective January 2010. I’m currently on H1B (expiring dec-2013). Can my husband apply for my GC in 2013 in his 4th year of permanent residency?
sparkle1 Posted December 13, 2012 Author Report Posted December 13, 2012 Yes.. But if he doesn’t apply then I will have to leave the country by dec-2013 as my 6 yrs are getting over then.. Its ok if the application takes time as long as I don’t have to leave.
pontevecchio Posted December 14, 2012 Report Posted December 14, 2012 You should be able to have him file in F2A now. The current wait is 2 years. Once he is a citizen he can update the filing with that fact. A discussion with a Lawyer may be beneficial specially if you do it soon.
