I have previously stamped H1B visa (Valid Oct 2007 to Mar 2009-Never Used) in same Company A but never worked with H1B. My Questions: 1.Can I apply H1B extension in same Company A (L to H conversion) based on my previously approved I-797. 2. If above answer is YES then Can I apply H1B extn USA itself or Out of USA?. 3. Can I apply H1B extension with another Company B based on my old I797?. Please clarify. Thanks for your help. Thanks for the update. Can I file H1b extension in USA itself or Do I have to move out of USA and file?. pontevecchio Posted December 14, 2012 Report Share Posted December 14, 2012 You cannot file a H1 petition. Only your potential H1 employer can file. If the H1 employer files with COS you will have to stop working for the L1 employer on that date. If getting a H1 visa is not your problem you can have the H1 sponsor file without COS and then on approval finish your L1 notice and leave and come back with a H1 visa. Link to comment

My L1 visa expiring soon so I'm requesting my current (same) employer to file H1 extension. But I didn't get any confirmation so verifying with you.
