ptry Posted December 12, 2012 Report Share Posted December 12, 2012 Hi, I am currently in L1 and my company is in the process of extending it as it is getting expired in Feb 2013. Meantime another employer is ready to do a H1 transfer(I have a previous H1 filing still valid) during the same time. So my question is in case if USCIS approves my H1 COS first and after that L1 extension gets approved then what status I would be in? Whether the H1 status will be voided and I need to still work with L1 employer? Thanks Link to comment
pontevecchio Posted December 12, 2012 Report Share Posted December 12, 2012 Have the new employer file and get the H1 petition approved without COS. Once approved give your L1 notice and then go and get your H1 visa and come back. Link to comment

Could you tell me if there is any difference between L1 to H1 "transfer"/"Change of Status" and L1 to "fresh H1"? The difference I heard from one of my friend is that in case of L1 to H1 "transfer"/"Change of Status" the period of stay of 6 years is taken as combined stay of L1 and H1 but in case of L1 to "fresh H1" we have to go back to country of origin and get H1 stamped and the amount of years stayed in L1 wouldn't matter and we would get full fresh 6 years for H1, is this true??
