I140 approved, PD:Current, I485 applied, have until July31 on 6th year

Hello,

LCA was submitted on 07/26/2012 and approved 10/12/12

I-140 approved 12/10/12.

My H1B will expire 07/31/13. (6th year)

PD is current.

Is there anyway I can extend my H1B or stay legally in US after 07/31/13.

Hei,

i believe yo have atleast 2 options

1. You could use EAD to stay till you get GC

2. You can apply for 3 year extension using I 140 approval

Surely you know you can get H1 extensions 3 years at a time with an approved I-140. I would also add that the EAD will only be applicable when your dates are current.

So, from what I read on forums so far, I think, for 3 year extension, even if your I-140 is approved your Priority Date shouldn't be current, and for EAD your PD should be current.
