H4 to H1 stamping from india during the divorce case running in India

Hi My sister got married three years back to a H1b holder and went to usa on H4 ..before going to usa she used to work for an MNC in india and she applied for H1B ... mean while marriage got setteled and went to usa on h4 .. then she got her h1 approved and she never worked or changed her status from H4 to H1 and h1 approval notice got expired last year and now they are seperated and she is now trying to find job and here i have few question please help answering them thanks..

1. As the divorce case is still running can she go for H1B stamping in India or will that be a problem ?

2.She already gave interview from india and got the client ..so,how long the whole process take and what is the exact procedure to follow?

sHE NEEDS A h1 SPONSOR TO FILE HER h1 PETITION AND GET IT APPROVED AND THEN GET THE VISA . She is not subject to the cap.
