Non Payment of salary while on H1B visa

Hi,

I was employed as a Financial advisor by a top insurance company since 1998 on a H1B visa.

I finally got my Green card in 2011.

For most of the period while I was on H1B visa I was not paid any salary, though employer always filed LCA claiming to be paying me the required H1B wage.

During this period I managed to earn decent money by means of commissions on Financial products that I sold for the company. There was no minimum guaranteed amount of payment. I was paid commissions in direct proportion to the quantity of premiums earned by the company on their products that I sold. If I could not sell any products I would get no commission and consequently no earnings.

My question is, can I sue the company for H1B required back wages, not paid from 1998.

=> It's not the dogs life in H1b, some people choose the dogs life in H1b. Not only H1bs, any one, like GC holders, USC all are free to choose a life.
