kdlo12 Posted December 2, 2012 Report Posted December 2, 2012 Hi, I have H1B approval (L1 to H1 COS) and the stamping is scheduled soon. Can I enter US with this stamping and transfer my H1 to company B upon arrival?
pontevecchio Posted December 3, 2012 Report Posted December 3, 2012 Does that mean you have a preconceived intention of not working for the existing H1 sponsor?
kdlo12 Posted December 4, 2012 Author Report Posted December 4, 2012 No, but it is a possibility. So, if that scenario arises, do you recommend me getting a stamping with the new sponsor or travel with the stamp which has existing sponsor? Also, if I can travel to work for the new sponsor with the existing stamping, can the H1 transfer initiated before my travel? Thank you very much.
pontevecchio Posted December 4, 2012 Report Posted December 4, 2012 You can use the existing visa along with the approved H1 petition of the company you will be working for on coming here. Of course you are allowed to get a new H1 sponsor at any time.
t75 Posted December 5, 2012 Report Posted December 5, 2012 If you do not intend to work for your current sponsor, you should wait for the approval notice for the company you do intend to work for.
