harry.p
Hello, I have questions on H1b status and transfer as followings. If a person leaves a current employer on valid H1b visa, petition and status and goes out of USA. 1) After how long period his current status on valid H1b becomes in-valid ? 2) Can he re-enter on same H1b visa & petition for same employer after few months to work for the same employer based on new offer letter? 3) Can he successfully transfer H1b to new employer after few months? What could be the right process to successfully transfer H2b to a new employer? Thanks for the responses in advance! Link to comment
pontevecchio
1. One has no status outside the USA. 2. It is always a better idea for the company to file another H1 petition in such cases. 3. He cannot. A H1 sponsor can file his H1 petition . Link to comment

Understand that another H1 petition is better idea, however is it illegal to enter on same approved old petition, valid visa and new offer letter from same old employer A to work for A?
