akrao Posted November 29, 2012 Report Posted November 29, 2012 I am on H1B and got married in 2012 and my wife came to US on H4 in June 2012. Both had I94 valid until October 2nd, 2012 ( my H1B expiry date). My employer filed for my H1B extension and he didn't file for an extension for my wife for H4. My H1B got approved before October 2, 2012 but we are not aware that we have to file for H4 extension for my wife. So now her I94 expired more than 2 months ago. I came to know that yesterday itself when I was preparing documentation for our H1B and H4 stamping in Canada in the next 1 week. We already have an appointment scheduled in Canada for next week for both of us. Will it become a problem during our visa interview to get my h1b visa and her H4 visa . I am confused. Can someone advise . a)Can we go to Canada for both our H1B and H4 Stamping : will this affect my H1B stamping also, or b) Have my H1B stamping in Canada and go to home country for her H4 stamping or c) apply for H4 extension now without leaving the country.
