While I'm there, my employer will file for my H1B so that I can return in October 2013. However, my employer also wants me to work from India during the 9 months I'll spend in India, and he wants to pay me in my US bank account. Can I legally get money in my US bank account while I'm in India without an H1B? Thanks! Link to comment
shandan Posted November 29, 2012 Report Share Posted November 29, 2012 I do not see any problems, as USCIS does not care about you when you are not Physcially in US. There can be tax implications since you will have US earnings and those will be reported to IRS, so you need to clear the scenario with the company HR and your tax consultant. Link to comment
