I have not yet got the H1 B visa stamped in my passport but have the approved notice. though I do not have the approved H1B petition with me, its with my current employer Can I transfer the H1-B approved petition to another employer even though it is not used by the current employee while I'm in US. Thanks Link to comment
pontevecchio
Subject to the total of 6 years L1/H1 status you can have another sponsor file your H1 non cap petition. Link to comment
nkForum
Hi, Thanks for the reply. So just to get more light on the next procedure : For my new sponsor , will that be enough if i give the Petition number and they can file a new H1B non cap petition based on that even though I'm not is the H!B status. Also what happens to my current L1B , when the L1B gets cancelled or expired . Link to comment

pontevecchio
They may ask for some proof like an approved petition. You do have your copy? If not its the companies baby to make do. Link to comment
nkForum
Sorry , I do not have the copy with me. though i have copy of I-797 with me . So is the the new sponsor needs to create a new one or they can pull up from USCIS site??. Link to comment
pontevecchio
The copy of the H1 approval is proof enough. As you point out your decision is to accept the job and it is their problem vis a vis the H1 petition filing and approval. Link to comment
