Arun04 Posted November 24, 2012 Report Share Posted November 24, 2012 I know that there are multiple queries on this topic but my situation is a little different as I am not the primary applicant on the I-485 application and neither am I on H4 visa but on H1B. Current Scenario: My wife's I-485 was filed and as I was filed as a dependent on her application, I have an EAD card. I am now thinking of switching from my H1B visa status to EAD to save remaining 2.5 years on my H1B. My concerns are: 1. If my wife's I-485 application gets denied and my employer files for my H1B, will I face any issues for switching back from EAD to H1B visa status? 2. Also if move to EAD, is there a time limit as to when I should switch back to H1B to prevent going into the quota? I last enetred into US with a stamped H1B visa in 2010 valid until Sept 2012 but I also have an approved H1B extension until 2014. 3. If for any reason, I have to switch back to H1B, will this have any implications on my wife's I-485? Your answers will be appreciated. Link to comment
