Hi .

I had H1b in year 2009 , I work for 1 year but due to some personal reason i had to go to India in 2010 . I was issued 221g on H1b ,I waited for some months but no response. So I came back to USA on H4 visa in 2011. I have approved I797 from my old employer till August 2013 . I want to work on H1 again. Do i need to change status from h4 to h1, I will change my employer too ? Or I need to file a new H1b , Will the quota system apply now?

Is my old H1b still valid. I didnt get any response about my H1b query. I just got a mail In year 2011 that 221g query is under review.Do i need to call USCIS to know the status of my old h1b?

You will need to find a H1 sponsor to file your non cap H1 petition and get it approved.
