idcagreencard Posted November 16, 2012 Report Posted November 16, 2012 i changed from h4 to h1 and started working. i have a valid h4 visa stamp valid till end of next year. if i travel to somewhere outside US in december and come back - do i need to go for h1b stamplng? or can i travel on the h4 visa but have a copy of my h1b petition with me? thanks

pontevecchio Posted November 16, 2012 Report Posted November 16, 2012 Yes. If you want to come back to work for the H1 sponsor you need to come back with the H1 visa.
kiran234 Posted November 16, 2012 Report Posted November 16, 2012 If you want to comeback and continue working...you need H1b visa. If you use your H4 visa while coming back....your H1b is no longer valid and Your employer must apply/ammend your status back to H1B for you again. You can not continue working under h1b before COS is approved again. Please discuss your case/plans with your employer and attorney.
